General Terms of Use of the site kreatinc.com

Article 1: Presentation of the website kreatinc.com:

kreatinc.com is the website (hereafter “Site”) of the company KREATINC S.A.R.L. à A.U.

KREATINC is a Moroccan S.A.R.L. A.U. located in Ali Yaeta Avenue, Tecno Ayad Building Bloc C N. 15, Administrative District (Al Wilaya), 93040 Tétouan - Morocco. It is registered in Tétouan Trade Register under the number: 20991 and under the Fiscal Identifier: 18815849.

The Site kreatinc.com is composed of four (4) sections:

Article 2 : Access and use of the Site:

The use of the Site is open to any person having an Internet connection. Access to the Site kreatinc.com, which is free and without obligation to purchase, entails full and unreserved acceptance of these General Terms of Use (hereinafter "GTU").

In addition to these Terms of Use the user of the Site (hereinafter the "User") is required to accept other Terms and Conditions in the context of products and / or services available through the Site kreatinc.com.

Article 3: Intellectual property:

The kreatinc.com website is the property of KREATINC S.A.R.L. à A.U.

The presentation and the content of this Site constitute an original work protected by the laws and international treaties in force on intellectual property and in particular by those on copyright and related rights, drawings, models and trademarks.

The Site includes texts, images, photographs, logos, and brands that are the property of KREATINC S.A.R.L. à A.U. or some of which are the subject of an exploitation authorization for the benefit of KREATINC S.A.R.L. à A.U. when they are the property of KREATINC S.A.R.L. à A.U.'s partners. These elements are themselves protected by industrial and intellectual property rights.

The reproduction, representation, distribution or exploitation in a general way, total or partial, in any form whatsoever, of all or part of the elements composing the kreatinc.com site which are proposed there, without the express and prior authorization of KREATINC S.A.R.L. à A.U. and the holders of the rights, are strictly forbidden and would constitute an infringement punishable under the rules governing intellectual property.

The introduction of data on the Site, which would modify or which would be likely to modify the content or the appearance of the data, the presentation or the organization of the Site or the works appearing on the Site and by any process whatsoever is strictly forbidden.

KREATINC S.A.R.L. à A.U. reserves the right to prosecute any person who would violate the respect of its intellectual property rights. This infringement is likely to be penalized and civilly sanctioned, in particular under the title of counterfeiting or infringement of copyrights and neighboring rights leading to the payment of damages if necessary.

Article 4: Responsibility of KREATINC S.A.R.L. à A.U.:

KREATINC S.A.R.L. à A.U. deploys its best efforts so that the kreatinc.com website is accessible 24 hours a day and 7 days a week in the best conditions of comfort of use.

KREATINC S.A.R.L. à A.U. cannot guarantee to provide the Site free of any defect, and as a result, the Site may be subject to computer bugs or malfunctions related to network connections and this may lead to the temporary unavailability of the Site.

KREATINC S.A.R.L. à A.U. may be required, at any time, to modify or interrupt temporarily or for an indefinite period of time all or part of the Site to carry out maintenance operations and/or make improvements and/or modifications to the Site.

Consequently, KREATINC S.A.R.L. à A.U. cannot be held responsible for any damage resulting from an interruption of the Site, alteration of its functioning or of the quality of the information delivered on it.

Moreover, KREATINC S.A.R.L. à A.U. cannot be held responsible for the acts of the Users that are contrary to the rules mentioned in the present GTU, nor for any direct or indirect damage resulting from the use of the Site and this, for any reason whatsoever, in particular, in case of typographical errors, and technical problems and inaccuracies such as a virus, a computer bug, a malicious intrusion or a dysfunction of the Site independent of KREATINC S.A.R.L. à A.U.'s will.

The use of the information available on the Site is done under the whole and only responsibility of the User.

The Users of the kreatinc.com website release KREATINC S.A.R.L. à A.U. from any responsibility for any damage of any kind that may result directly or indirectly from their use of the website.

Article 5: Responsibility of the User:

The User declares that he/she is familiar with the Internet, its characteristics and limitations and acknowledges that he/she is aware of the nature of the Internet network and in particular of its technical performance and response times for consulting, querying or transferring information data.

The User commits to :

Provide KREATINC S.A.R.L. à A.U. with accurate and up-to-date information. Not to use any device, software or routine to interfere or attempt to interfere with the proper functioning of the kreatinc.com Site. Refrain from storing, downloading or sending any data prohibited, illegal, contrary to morality or public order and / or infringing on the rights of third parties and particularly intellectual property rights belonging to third parties. To ensure the security of the Site, KREATINC S.A.R.L. à A.U. takes all necessary and adequate measures to protect Personal Data against any loss, misuse, unauthorized access, alteration or destruction, in accordance with the provisions of Law 09-08 on the protection of individuals with regard to the processing of personal data. However, KREATINC S.A.R.L. à A.U. cannot offer an absolute guarantee of security, as the Internet is an open network, sensitive by nature to such risks.

Article 9: Personal data:

In accordance with the provisions of the law n°09-08 relating to the protection of individuals with regard to the processing of personal data, the User acknowledges and accepts that the personal data (family name, first name, address, etc.) declared by him/her when using the Site are intended for KREATINC S.A.R.L. à A.U. and are subject to processing for the needs of the management of services provided to him/her, and, if necessary, for any direct marketing operation, whatever the media used, carried out by KREATINC S.A.R.L. à A.U. to inform the User of its offers and services, once he/she has given his/her consent.

Article 10: Modifications:

The present GTU can be modified and updated at any time and without prior notice by KREATINC S.A.R.L. à A.U, in particular to adapt them to legislative and regulatory changes, or to modify the functionalities proposed within the framework of the kreatinc.com site if circumstances so require. The said modifications and updates come into effect as soon as they are published on the Site.

Article 11: Applicable law and jurisdiction:

The present GTU are subject to Moroccan law. In the absence of an amicable agreement, the Commercial Court of Tangier shall have sole jurisdiction to hear any dispute arising from the application or interpretation of these GTU.
